Terms and Conditions

This Agreement is made between you being the user of Discovery Bay Application (“this Application”) and Hong Kong Resort Company Limited (“Our Company”) being the owner of this Application. Your first use of this Application shall deem to be your agreement to comply with and be bound by these terms and privacy policy. If you do not agree to be bound by these terms and privacy policy, you should stop using this Application immediately. These terms and privacy policy may be modified from time to time without prior notice. By continuing to use this Application upon such modifications, you agree to comply with and be bound by the same.

Ownership of the Application

While Our Company licenses the use of the Application to you on the basis of this Agreement, we retain all right, title and interest (including intellectual property rights) in or on all text, graphic images, trademarks, service marks, logos, icons, sound clips, video clips, data compilations, page layout, underlying code (including object and source codes), software and any other materials (the “Content(s)”) in and to the Application which are owned by Our Company and/or its associated companies (the “Our Company Group”). Any act of copying or “mirroring” the Application or the Contents on your device and/or server, or modifying, editing, commercially exploiting or disseminating in any form whatsoever the Contents or re-using the text, graphics or materials on the Application or reverse-engineering, disassembling, attempting to derive the source code of, modifying, or creating derivative works of the Application, any updates, or any part thereof without the prior written permission of Our Company, is prohibited.

Our Company does not sell the Application to you. Our Company Group remains the owner or authorized user of the Application and Content at all times. Our Company reserves all rights not expressly set out in these terms and privacy policy.

 

Links from the Application

The Application may contain links to other sites and resources provided by third parties, or links to application stores where you may download third party mobile applications. These links are provided for your information and/or easy access only. We have no control or influence whatsoever over those sites, resources, third-party mobile applications or their contents, and to the maximum extent permitted by law, we accept no responsibility for them or for any loss or damage that may arise from your use of them. Your interaction with those sites or resources or third-party mobile applications will be wholly at your own risk and your sole responsibility, and you may be subject to terms of use, privacy policies or other provisions of those sites or resources or mobile application. The inclusion of a link to another site or resource or third-party mobile application from the Application does not imply any recommendation or endorsement of the sites or resources or mobile applications themselves or of those in control of them or our association with them.

 

Disclaimer

This Application is provided on an "as is" and "as available" basis. We do not guarantee that this Application is compatible with your mobile device or that this Application and our website are free of errors, defects, malware and viruses or that this Application and our website and the contents thereof are correct, up-to-date and accurate.

All information contained in this Application and its database are for reference only. This Application is perceived to provide customer services. Our Company makes no warranty whatsoever, whether expressed or implied, as to the accuracy, thoroughness, adequacy, quality, validity, suitability and completeness of the information therein. In addition, Our Company disclaims any and all liability for any disruption and/or non-availability and/or suspension and/or discontinuance of this Application or its service resulting from any factors or failures whatsoever.

All schedule and times of our services are subject to change from time to time without prior notice.

Any confirmed booking or arrival times of Hire Car Services are best estimations only and we shall have no liability if a confirmed booking or arrival time is inconsistent with any estimate given or otherwise should fall short of your expectation for whatever reason nor shall we have any other liability to you in connection with the time at which you and/or the luggage accompanying to be transported reach or fail to reach the destination. 

The booking and use of Hire Car Services is at your own risk. To the fullest extent permitted by applicable law, we shall not be liable for any loss or damage resulting from or in connection with the use or inability to use Hire Car Services (including any consequential, indirect, incidental damage or any loss of profit or damage to your mobile device).

 

Limitation of liability

To the fullest extent permitted by applicable law, our Company disclaims any and all liability for any direct or indirect loss or damage arising out of and/or in connection with the use of this Application and/or the reliance on any information/data contained therein. Please be aware that your use of this Application and reliance on its contents are at your own risk.

 

Indemnity

You agree to indemnify Our Company Group in full and on demand from and against any claim, proceeding, loss, damage, costs, expenses or other liabilities which we and/or they may suffer or incur directly or indirectly as a result of your fraud or negligence, or use of the Application otherwise than in accordance with this Agreement, or applicable laws.

 

Accuracy of data

Our Company would make every attempt to update the database to ensure the information contained in the Application is accurate. Our Company also reserves the right to make changes and/or corrections and/or improvements and/or modifications to the Application/ its database from time to time without notice. However, Our Company Group makes no warranty or representation that this Application will meet anyone’s requirements, fit for any particular purpose, or be compatible with all systems and/or software and/or firmware. Our Company Group disclaims any and all liability for loss or damage suffered directly or indirectly as a result of errors, omissions or discrepancies arising out of and/or in connection with the use of this Application, its system or services.

 

Intellectual property rights

Our Company Group retains all intellectual property rights – whether registered or not in any jurisdiction – (including copyright, trademark and patent) in all contents, displays, data compilation, underlying code and software etc of this Application. It is strictly prohibited to copy the information herein and/or modify and/or reuse the text and/or graphics and/or design of this Application in any way without the prior written approval of Our Company Group. It is also strictly prohibited to use any of the said materials for commercial purposes. By continuing to use this Application, you acknowledge that all those materials are protected by applicable Hong Kong and international laws on intellectual property and in general.

 

Personal Data

In relation to our promotions, products and services offered, it is essential for the user to provide us with personal information and data in connection with obtaining or continuing to enjoy, receive and use the promotions, products and services. If you do not provide accurate and correct data or information as required, Our Company Group may at its absolute discretion discontinue or refuse to provide such promotions, products and services.

All transaction data created, in relation to all the promotions, products and services provided, are the properties of Our Company Group.

You agree that all the data and information provided to Our Company Group and data relating to the use of services may be used by Our Company Group for:

• processing an application for the promotions, products and services of Our Company Group;
• the management, operation and maintenance of all operating systems, including audit purposes;
• creating new or improving current promotions, products and services provided by Our Company Group or its business partners;
• communications with you;
• processing or investigation of enquiry, complaints, suspected doubtful transactions and research for service improvement;
• prevention or detection of crime;
• disclosure as required by law;
• a source of information and data for transport and other services in general; and
• any other related purposes.

The data and information you provided to Our Company Group will be kept as confidential information.  And you agree that those data and information and data relating to the enjoyment, receipt and use of promotions, products and services, may be transferred or disclosed to the following parties:

• any agent, contractor or third party service provider who provides system development and integration, data processing, administrative, telecommunication, payment or other services to Our Company Group in relation to the design, development, implementation and operation of any services for Our Company Group under a duty of confidentiality to Our Company Group;
• any other person and organization under a duty of confidentiality to Our Company Group or its business partners; and
• any person and organization to whom Our Company is obliged to provide or disclose such information under the requirement of any statutory requirements.

You have the right to:

• check if Our Company Group keeps any personal information and data about you, and access to the data;
• request us to correct any personal information and data relating to you which is outdated or inaccurate;
• ascertain our policies and practices in relation to personal data and to be informed of the kind of personal data held by Our Company Group; and
• request Our Company Group not to use the personal data of you for direct marketing purposes (if any), in which case Our Company Group will cease to do so at no cost from you.

Our Company reserves the right to charge you a reasonable service fee for processing any request to access or update your personal information and data held by us, and to disclose any transaction data relating to promotions, products and services provided to you.

 

Governing Law and Jurisdiction

Without prejudice to any other rights of Our Company, Our Company reserves the right to suspend and/or terminate your access to and/or use of this Application or any promotions, products and services in relation thereto if you have committed any breach of these terms and privacy policy. These terms and privacy policy shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). Our Company and you hereby agree to submit to the exclusive jurisdiction of the Hong Kong courts.

 

Language

If there is any conflict and/or difference between the English version and the Chinese version of these terms and privacy policy, the English version shall prevail.

使用條款

本協議由閣下身為 「愉景灣」應用程式 (「本應用程式」) 之使用方及 香港興業有限公司 (統稱「本公司」/「我們」) 身為本應用程式之擁有方訂立。閣下開始使用本應用程式代表閣下同意遵守並受下列使用條款及私隱政策約束(「本使用條款」)。倘若閣下不同意受本使用條款約束，閣下應立刻停止使用本應用程式。本使用條款會被不時修改而不作事先通知。如閣下在本使用條款經修訂後繼續使用本應用程式，即代表閣下同意受經修訂之本使用條款約束。

 

應用程式的所有權
雖然本公司根據本使用條款許可閣下使用本應用程式，我們保留對本公司及/或有聯繫公司（「本集團」）擁有的應用程式的所有文本、圖像、商標、服務商標、標誌、圖示、音頻剪輯、視頻剪輯、資料彙編、頁面佈局、相關代碼（包括目標代碼和源代碼）、軟件及任何其他材料（「內容」）的所有權利、所有權和權益（包括知識產權）。未經本公司事先書面允許，禁止在閣下的設備及/或伺服器上複製或抄襲應用程式或內容，或以任何形式修改、編輯、商業化利用或傳播內容，或重新使用應用程式的文本、圖形或材料，或對應用程式及其任何更新或任何部分的原始程式碼進行反向工程、反彙編、嘗試獲取有關原始程式碼、修改或就其建立衍生項目。

本公司不向閣下出售本應用程式，本集團始終為本應用程式和內容的所有人或獲授權使用者。

本公司保留本使用條款項下未明確授予的所有權利。

 

應用程式連接
應用程式可能含有由第三方提供的其他網站和資源的連接，或含有與閣下可下載第三方流動應用程式的應用商店的連接。這些連接僅供閣下參考及/或便於進入而已。我們對該等網站、資源、第三方流動應用程式或其內容沒有控制權或影響力，且在法律允許的最大範圍內，我們對前述各項或閣下使用前述各項引起的任何損失或損害概不負責。閣下與該等網站、資源或第三方流動應用程式的互動完全由閣下自行承擔風險和責任，且閣下可能須遵守該等網站、資源或流動應用程式的使用條款、私隱政策或其他規定。應用程式中納入與另一網站、資源或第三方流動應用程式的連接並不暗示任何推薦或認可該等網站、資源或流動應用程式本身或控制他們的主體或我們與他們有任何關聯。

 

免責聲明
本應用程式是基於 「現有狀況」 及 「現可提供」 的原則提供。我們不保證：本應用程式與閣下的流動裝置相容；或本應用程式（的內容）和我們的網站沒有錯誤、缺陷、惡意軟件和病毒；或本應用程式和我們的網站為正確、最新及準確的。

本應用程式內之資訊及資料只供參考。本應用程式所提供之資訊旨在提供客戶服務。本公司絕不明示或默示保證資料準確性、徹底性、充足性、品質、有效性、適用性及全面性。對於任何及所有因任何原因或故障引致本應用程式或服務中斷及/或暫停及/或終止之法律責任，本公司概不負責。

我們的服務時間和安排隨時可能更改，恕不另行通知。

租車服務的任何已確認之預約或到達時間只是最佳估計，如已確認之預約或到達時間因任何原因與任何估計或閣下的預期有異，我們一概不負上任何責任。我們亦不會為參與供應商接載閣下及/或貨品到達或未能到達目的地的時間負上任何責任。

預訂和使用租車服務的風險由閣下自負。在適用法律允許的最大範圍內，對於使用或不能使用租車服務所產生或與之有關的任何損失（包括任何相應、間接、偶然的損失或任何利潤的損失或對閣下的流動裝置造成的損害），我們一概不負上任何責任。

 

責任限制
在適用法律允許的最大範圍內，任何及所有由於及/或關於使用本應用程式及/或依賴任何本應用程式包含之內容/資料所引致任何直接或間接之損失或損害，本公司概不負責。請閣下務必清楚瞭解閣下在使用本應用程式及依賴其內容行事均需自行承擔風險。

 

彌償
對於我們及/或本集團之成員因閣下的欺詐或過失或閣下不根據本使用條款或適用法律使用應用程式而直接或間接遭受或發生的任何索償、訴訟、損失、損害、費用、支出或其他責任，一經要求，閣下同意全部作出彌償。

 

資料準確性
本公司會努力更新本應用程式的資料庫以確保其為準確，本公司亦保留其權利不時對之作出更改及/或更正及/或改進及/或修改而不事先另作通知。然而，至於本應用程式可否滿足閣下的要求、適合某一特定用途、或將與所有系統及/或軟件及/或韌體相容，本集團一概不作任何保證或陳述。對於任何及所有由於及/或關於使用本應用程式、系統或服務所產生的錯誤、遺漏或差異而引起的直接或間接之損失或損害，本集團概不負責。

 

知識產權
本集團保留所有於本應用程式所提供之資訊、顯示及配置模式、軟體、內容等之知識產權(包括版權、商標及專利權，無論是否已在任何司法管轄區內註冊)。未經本集團事先書面許可，嚴禁抄襲本資料及/或以任何形式修改及/或重用本應用程式之文字及/或圖像及/或設計，亦嚴禁使用本材料作商業用途。如果閣下繼續使用本應用程式，即閣下承認本材料受香港及國際知識產權及其他法律之保護。

 

個人資料
就我們提供的促銷活動、產品和服務而言，閣下需向我們提供個人資料以獲取或繼續使用該等促銷活動、產品和服務。如任何閣下不提供所需的準確無誤資料，本集團有權終止或拒絕提供該等促銷活動、產品和服務。
一切由提供促銷活動、產品和服務而衍生的交易數據屬本集團所有。

閣下同意，給予本集團的所有資料和關於使用服務的數據，可由本集團為下列目的使用：

• 處理本集團促銷活動、產品和服務的申請；
• 營運系統的管理、運作和維修，包括審計；
• 推出新服務或改善現有服務，包括本集團或其商業夥伴提供的服務；
• 與閣下聯絡；
• 調查或處理查詢、投訴、懷疑問題交易，以及改善服務的研究；
• 防止或偵測罪行；
• 法例要求的披露；
• 交通和其他服務的一般資料來源；以及
• 任何其他相關目的。

閣下向本集團提供的資料會予以保密。閣下亦同意，該等資料以及與促銷活動、產品和服務的享受、接收和使用有關的數據或會向下列各方傳達或披露：

• 任何就服務的設計、發展、執行和運作向本集團提供系統發展及融合、數據處理、行政、電訊、付款或其他服務並對本集團有保密責任的代理、承辦商或第三方服務供應者；
• 任何其他對本集團或其商業夥伴有保密責任的人士和機構;
• 本公司在法例規定下須向之提供或披露該等資料的任何人士和機構。

閣下有權：

• 查明本集團是否保存其任何個人資料並查看該等資料；
• 要求本公司更正任何過時或不準確的個人資料；
• 查證本公司關於個人資料的政策和常規並獲悉本集團持有何等個人資料：
• 要求本集團不要將其個人資料用作直銷目的（如有的話）－－如接獲此要求，本集團會停止上述使用而不會向閣下收費。

本公司保留權利就處理任何查詢向閣下收取合理費用，包括查看或更新由本公司持有的閣下個人資料，以及披露任何關於已向閣下提供之促銷活動、產品和服務的交易數據。

 

管轄法律
在不損害本公司的任何其他權利的原則下，如閣下違反本使用條款，本公司保留權利暫停及/或終止閣下進入及/或使用本應用程式或任何與之有關的促銷活動、產品和服務。本使用條款受中華人民共和國香港特別行政區(「香港」)法律之管轄並按照香港法律詮釋，本公司及閣下同意香港法庭對於任何關於使用條款的專有司法管轄權。

 

以英文版本為準
本使用條款之中文版本及英文版本如有任何相異之處，一律以英文版本為準。
